1. The marketplace

EmaHome operates an online intermediation platform connecting independent property hosts with guests. EmaHome is not the host, the landlord, or the operator of any listed property.

2. Eligibility

You must be 18+ and legally capable of entering a contract. Hosts must comply with local short-term-rental laws (registration numbers shown on listings where required by law, e.g. France, Italy, Spain).

3. Commission

EmaHome charges a transparent 5% commission to hosts at launch, capped at 7% forever. No hidden guest service fees beyond the displayed cleaning fee and applicable VAT.

4. Right of withdrawal

Under Article 16(l) of the Consumer Rights Directive, accommodation services for a specific date are exempt from the 14-day withdrawal right. Each listing's cancellation policy applies instead and is shown before booking.

5. Host obligations

Accurate listing, lawful operation, valid insurance, compliance with safety standards (smoke detectors, emergency exits), tax declaration (DAC7 reporting handled by EmaHome).

6. Guest obligations

Respect the property and house rules, pay on time, leave the property in the condition received.

7. Liability

EmaHome's liability is limited to the commission earned on the disputed booking, except in cases of gross negligence or wilful misconduct.

8. Disputes (ODR)

EU consumers may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Governing law: Luxembourg. Jurisdiction: Luxembourg courts, without prejudice to mandatory consumer protections.
